În Regulamentul cu privire la tratamentul riscului de piață potrivit abordării standardizate, aprobat prin Hotărârea Comitetului executiv al Băncii Naționale a Moldovei nr.114 din 24 mai 2018 (Monitorul Oficial al Republicii Moldova, 2018, nr.183-194, art.904):

1. Punctul 136 se va citi:

„136. Sub rezerva pct.137–148, băncile își calculează cerința de fonduri proprii pentru riscul de marfă utilizând una dintre metodele prevăzute la secțiunea 2, subsecțiunile 1 – 3 din prezentul capitol.

137. Băncile care desfășoară activități cu instrumente financiare al căror suport sunt materii prime agricole și dețin sau își asumă poziții în aceste instrumente pot stabili cerințele de fonduri proprii aferente mărfurilor suport la sfârșitul fiecărui an pentru anul următor, dacă sunt îndeplinite cumulativ următoarele condiții:

a) în orice moment al anului, banca deține fonduri proprii pentru acest risc care nu sunt mai mici decât media cerinței de fonduri proprii pentru riscul respectiv, estimată de o manieră prudentă pentru anul următor;

b) banca estimează de o manieră prudentă volatilitatea așteptată a cifrei calculate conform lit. a);

c) media cerinței de fonduri proprii pentru acest risc nu depășește 5% din fondurile sale proprii sau 10 milioane MDL și, ținând cont de volatilitatea estimată în conformitate cu lit. b), valoarea maximă așteptată a cerințelor de fonduri proprii nu depășește 6,5% din fondurile sale proprii;

d) banca monitorizează în permanență dacă estimările efectuate în conformitate cu lit. a) și b) continuă să reflecte realitatea.

2. Punctele 137-158 se vor renumerota consecutiv în punctele 138-159.

Notaries no longer require a budget arrears certificate for property

Law no. 77 of 07.06.2018 removes from Article 51 paragraph (1) of the Law on notaries the requirement to present a certificate from the State Fiscal Service on the absence or existence of arrears to the budget for the property concerned. The change entered into force on 22.06.2018. The text does not specify other categories of people affected.

Collective dismissals: new rules on notice, consultation and warning from 22.06.2018

Law No. 85 of 24.05.2018 amends the Labour Code and adds Article 185¹ on collective dismissals. Employers must notify employee representatives and the employment agency, start consultations and give employees 2 months' written notice before dismissal. The law entered into force on 22.06.2018.

Parliament ratifies Amendment No. 1 to the loan agreement with the Council of Europe Development Bank

Parliament ratified Amendment No. 1 to the Framework Loan Agreement between the Republic of Moldova and the Council of Europe Development Bank, signed in Chisinau on 11 April 2018. The amendment changes the rule on privatizing social housing financed under the project, which will now follow the national housing and privatization laws in force. The law entered into force on 22.06.2018.

Customs and VAT relief for building the “Yardimnic” elderly care home in Ceadîr-Lunga

As an exception, the law allows the import and/or supply of goods and services for building the “Yardimnic” elderly care home in Ceadîr-Lunga, Gagauzia, without customs duty, customs procedure fee and VAT without the right to deduct. The beneficiaries are the Moldovan branch of a non-resident representative office of the Turkish firm “CENK OSMAN AKSOY C AKS MIMARLIK MÜHENDISLIK VE INȘAAT” and the foreign-capital company “VEZIR CONSTRUCT” SRL. The law entered into force on 22.06.2018.
