Law No. 118/2016: new rules for identity documents and leaving the country

The law changes the rules for issuing identity documents and the restrictions on leaving the country. An application can be refused if the applicant faces criminal or preventive measures, and citizens may hold two valid passports with identical personal data. The law entered into force on 05.08.2016.

Changes to the Criminal, Civil Procedure and Contraventions Codes, in force from 05.08.2016

Law nr. 122 amends the Criminal Procedure Code, the Civil Procedure Code and the Contraventions Code. Among the changes, courts must state reasons whether human rights were violated when parties invoke the European Convention, and prosecutors must give reasons for their actions. Some penalties for traffic violations are changed. The law enters into force on 05.08.2016, and the Government must bring its acts into line within 6 months.

Alarm systems for private security redefined under Law No. 169 of 2016

Law No. 169 of 15.07.2016 amends Law No. 283-XV on private detective and security activity. The definition of an alarm system is extended to include smoke, temperature, fire and gas detectors, panic buttons and closed-circuit television. The law enters into force on 05.08.2016.

Interior Ministry exempted from compensating losses from removing land from agricultural use

Law No. 171 of 15.07.2016 exempts the Ministry of Internal Affairs from compensating losses of 371 717 lei. The losses were caused by removing six plots from agricultural use, allocated for building a radio communications network. The law applies as an exception to Law No. 1308-XIII of 25 July 1997 and entered into force on 05.08.2016.

Temporary replacement of liquidator for BC «INVESTPRIVATBANK» S.A. and BC «UNIBANK» S.A. under liquidation

During the leave period of 05.08.2016 to 23.08.2016, liquidator Iulian Țurcan is replaced by Silvia Marcu, who takes over the role of liquidator for both banks. When the period ends, Silvia Marcu hands management and control back to Iulian Țurcan. The ordinance entered into force on 26.07.2016.

Operations on bank accounts of two insurance and reinsurance brokers suspended

The National Commission for Financial Market suspended operations on the bank accounts of the insurance and reinsurance broker "ASTRA LUX" S.R.L. and the insurance and reinsurance broker "STAR INSURANCE" S.R.L. Adding money to the accounts is still allowed until the debts to the Commission and the calculated penalties are fully paid. Withdrawing funds to repay debts to insurers and to the supervisory authority needs the Commission's prior approval. The act entered into force on 22.07.2016. The text was repealed by HCNPF4/11 of 03.02.17.

CNPF starts a complex inspection of A.E.Î. "BUSINESS CREDIT" for 01.08.2013-31.07.2016

The National Financial Market Commission decided to check how A.E.Î. "BUSINESS CREDIT" complies with the law on savings and loan associations. The inspection covers 01.08.2013-31.07.2016. The order took effect on 22.07.2016.

The National Commission of the Financial Market decided to start a complex audit of compliance with the legislation on savings and loan associations by A.E.Î. "MICROÎMPRUMUT". The audit covers the period 01.01.2014-31.08.2016. The ordinance entered into force on 22.07.2016.

CNPF requires prior approval for changes in securities holder registers at Registru-Corect S.A.

The National Commission for Financial Market issued a provisional ordinance for the registrar company Registru-Corect S.A. Until the identified deviations are checked and examined, the company may register changes in securities holder registers only with the Commission's prior approval. The ordinance took effect on 22.07.2016.
